Terms and Conditions for the Scale Your Salary Program by Elevated Technologies LLC

Welcome to Elevated Technologies LLC (“ET,” “we,” “our,” or “us”) and the Scale Your Salary Program (“Program”). By accessing or participating in the Program, you agree to the following Terms and Conditions (“Terms”), which form a binding legal agreement between you and ET. If you do not agree, you must not enroll in or use the Program.

1. Acceptance of Terms

By registering for, purchasing, or participating in the Program, you acknowledge that you:

  • Have read, understood, and agree to be bound by these Terms;

  • Are legally capable of entering into a binding agreement; and

  • Will comply with all applicable laws and regulations in connection with your participation.

2. Eligibility

  • The Program is intended for individuals 18 years or older.

  • You must provide accurate, complete, and up-to-date information during registration.

  • ET reserves the right to reject, suspend, or terminate any participant for failure to meet eligibility or compliance requirements.

3. Scope of Services

  • The Program provides educational, coaching, and job-search support services designed to assist professionals in enhancing career opportunities.

  • No Universal Guarantee: Participation does not guarantee a job offer, salary increase, or specific outcome.

  • Conditional Guarantee: Any guaranteed job placement or outcome is valid only when explicitly included in a mutually signed Client Contract. Unless such contract exists, no guarantee applies.

  • ET is not a staffing agency and does not act as your employer or recruiter.

4. Registration and Account Security

  • You are responsible for maintaining the confidentiality of your login credentials and account activity.

  • ET is not liable for unauthorized access resulting from your failure to secure your account.

  • You must immediately notify ET of any unauthorized use of your account.

5. Payment Terms

  • Program fees must be paid in full or in accordance with any agreed-upon payment plan.

  • Failure to make timely payments may result in suspension or termination of access to the Program.

  • All fees are non-refundable except as explicitly stated in a mutually signed Client Agreement.

  • Chargebacks or disputed payments without prior written notice to ET will be considered a breach of contract and may result in legal action.

6. Refunds & Guarantees

  • Refunds are only available under conditions expressly outlined in a signed Client Contract.

  • Eligibility for refunds or guarantees may require you to complete specific actions (e.g., resume submission, application minimums, attendance at sessions).

  • Failure to comply with these requirements voids any refund or guarantee rights.

  • Unless otherwise agreed in writing, all sales are final.

7. Intellectual Property Rights

  • All Program content, including but not limited to videos, templates, software, written materials, tools, graphics, and branding, is the sole property of ET and protected by copyright, trademark, and other intellectual property laws.

  • You are granted a limited, non-exclusive, non-transferable license to use Program materials for your personal career advancement only.

  • You may not reproduce, distribute, sell, or exploit Program materials without ET’s prior written consent.

  • Unauthorized use will result in termination of access and may trigger legal action.

8. Participant Conduct

You agree that you will not:

  • Share Program content or login credentials with unauthorized parties;

  • Engage in unlawful, fraudulent, or harmful conduct;

  • Harass, abuse, or disrupt the learning environment for other participants;

  • Misrepresent outcomes of the Program or ET’s services.

ET reserves the right to remove participants from the Program, without refund, for misconduct or violation of these Terms.

9. Disclaimer of Warranties

  • The Program is provided on an “AS IS” and “AS AVAILABLE” basis.

  • ET makes no representations or warranties regarding accuracy, completeness, timeliness, reliability, or suitability of Program content.

  • ET does not warrant that the Program will be uninterrupted, error-free, secure, or free of viruses.

10. Limitation of Liability

To the fullest extent permitted by law:

  • ET, its affiliates, officers, employees, contractors, and agents shall not be liable for any indirect, incidental, consequential, special, punitive, or exemplary damages, including but not limited to loss of income, employment opportunities, or goodwill.

  • ET’s total liability for any claim arising out of the Program shall not exceed the amount paid by you for Program enrollment.

11. Indemnification

You agree to defend, indemnify, and hold harmless ET, its officers, directors, employees, and agents from any claims, liabilities, damages, losses, or expenses (including attorneys’ fees) arising out of:

  • Your participation in the Program;

  • Your violation of these Terms;

  • Your infringement of ET’s intellectual property or third-party rights.

12. Governing Law & Dispute Resolution

  • These Terms shall be governed by and construed under the laws of the State of Wyoming, without regard to conflict-of-law principles.

  • Any disputes shall first be subject to good faith negotiation.

  • If unresolved, disputes shall be submitted to binding arbitration in Wyoming under the rules of the American Arbitration Association.

  • By agreeing to arbitration, you waive your right to a jury trial or participation in class actions.

13. Modifications to Terms

ET reserves the right to update or modify these Terms at any time. Updates will be effective immediately upon posting on our website or notification to participants. Continued participation constitutes acceptance of updated Terms.

14. Severability

If any provision of these Terms is held invalid or unenforceable, the remaining provisions will continue in full force and effect.

15. Entire Agreement

These Terms, together with any signed Client Agreement, constitute the entire agreement between you and ET regarding the Program. No oral or written representations outside of these documents shall be binding.
